LAHORE: Justice Sheikh Azmat Saeed of the Lahore High Court (LHC) deferred hearing of a petition challenging the appointment of Malik Hussain Mubashar as the vice chancellor (VC) of the University of Health Sciences (UHS). The judge had already issued notices to the Punjab government, chief secretary, health secretary and others. A local citizen, Tahir Hameed, moved the petition claiming his right to challenge the impugned appointment being a taxpaying citizen of Pakistan. The petitioner’s counsel Nasir Mehmood Qureshi submitted that the UHS was an autonomous body which was established under “The University of Health Sciences, Lahore Ordinance, 2002”. He said that according to section 12 of this ordinance, Mubashar was appointed as the VC on April 12, 2003. He added that section 12(5) of the ordinance said that any person who is not eligible to be appointed as a professor, is also not eligible for the post of the VC. “Mubashar, after attaining the age of retirement on July 31, 2005, did not meet the criteria for the post of the VC, and thus his presence in the office was against the laws,” he claimed. Qureshi further alleged that the appointment of Mubashar was made in clear violation of the appointment policy as no applications from other eligible candidates were invited before the impugned appointment, neither other equally eligible candidates were provided with an opportunity to compete for the post. He requested to declare the appointment as illegal, adding that the authorities concerned should be directed to appoint a qualified person who would be eligible for the post.Daily time
